Umweltschutz durch Bauleitplanung
Local Land-use Planning and Environmental Protection

Zusammenfassung

Der Vorrang des Unionsrechts prägt das deutsche Umweltrecht. Deutsche Sonderwege wie eine Umweltleitplanung und das Umweltgesetzbuch, Allgemeiner Teil, haben sich nicht durchsetzen können. Qua Umweltrecht hat das Unionsrecht das Recht der Bauleitplanung umgestaltet. Im Katalog der gemäß § 1 Abs. 6 BauGB abzuwägenden Belange sind die des Umweltschutzes einschließlich Naturschutz und Landschaftspflege gemäß § 1 Abs. 6 Nr. 7 BauGB mit Abstand am differenziertesten und umfangreichsten. Diese Belange werden ergänzt durch § 1a BauGB – Bodenschutzklausel, Eingriffsregelung, FFH- und Vogelschutzrichtlinie, Biotop- und Artenschutz sowie Klimaschutzklausel. Der Baurechtskompromiss (1993/1998, §§ 8a – 8c BNatSchG a.F., § 18 BNatSchG) schuf die Grundlage für eine spezifische Berücksichtigung des Fachrechts in der Bauleitplanung. Die die UVP-&&Äuml;uml;nderungsrichtlinie umsetzende Novelle 2017 zum BauGB hält fest an der Integrationslösung des § 2 Abs. 4 BauGB, die die projektbezogene Umweltverträglichkeitsprüfung und die planbezogene Strategische Umweltprüfung zusammenfasst. Die Novelle 2017 hat durch die erweiterten Vorgaben der Anlage 1 zum BauGB die Wirksamkeit der Umweltprüfung in der Bauleitplanung verstärkt. Im Lichte der Nachhaltigkeitsstrategie der Bundesregierung ist der hohe Flächenverbrauch die Schwachstelle der Bauleitplanung. Gleiches gilt für § 35 BauGB – Schutz des Außenbereichs.

Abstract

German environmental law is coined by the primacy of European Union law over national law. Original German ideas like environmental master planning (Umweltleitplanung) and the environmental code have not gained acceptance. European regulations regarding the environment have led to amendments to the established provisions for local land-use planning. The catalogue of issues to be considered in depth in decision-making according to the Federal Building Code (art. 1 para. 6) contains several environmental matters (e.g. nature conservation and landscape). Art. 1a contains further relevant provisions from an environmental point of view including the soil protection clause, the climate protection clause, the impact mitigation principle, the Habitats Directive as well as provisions regarding species protection. The compromise reached on the Federal Building Code (1993 and 1998 on art. 8a – 8c Federal Nature Conservation Act, old version, art. 18 new version) provides the basis for the consideration of sectoral matters in local land-use planning. The 2017 amendments to the Federal Building Code (art. 2 para. 4) adhere to the integration of project EIA and SEA. The 2017 amendments increased the efficiency of environmental assessment in local land-use planning by the extended provisions in the annex 1 to the Federal Building Code. In the light of the sustainability strategy of federal government, land consumption remains the weak spot of local land-use planning. The same applies to the protection of undesignated outskirt areas (art. 35 Federal Building Code).
