Zusammenfassung

Der Artikel umreißt zunächst knapp die Entwicklung der Vorschriften über die Öffentlichkeitsbeteiligung. Anschließend befasst er sich mit dem Anwendungsbereich der Partizipationsvorschriften bei der Planung und Zulassung von Windenergieprojekten, den Zwecken der Beteiligung und den rechtlichen Vorgaben in solchen Verfahren. Dabei werden auch die aktuellen Änderungen des UVP-Gesetzes und anderer Vorschriften berücksichtigt, die die Mitwirkungsmöglichkeiten der Öffentlichkeit in einigen Punkten verbessert haben.

Abstract

This article first deals briefly with the historic development of public participation in planning and development consent procedures in Germany. Secondly, it gives an overview of the administrative procedures (referring to wind power development projects) in which the public, and/or nature conservation organisations, are entitled to take part under German law, and describes the aims and requirements of the relevant provisions. In this context, current legislation on environmental impact assessment and other subjects is also taken into account as it has improved the conditions for participation in some aspects.
