Transposing the revised EIA Directive into national legislation in Estonia

Abstract

Estonia has a long legislative and administrative history of applying environmental assessments. The first regulation dates back to 1992, and the first law on environmental assessment was adopted in 2000. Both of these legal acts addressed Environmental Impact Assessment (EIA) and Strategic Environmental Assessment (SEA). Appropriate Assessment prescribed in the Habitats Directive was added alongside the transposition process when Estonia joined the EU in 2004. The current EIA Law was adopted in 2005, and substantial amendments were initiated on 1 July 2015. Most notably, the decision-makers (who approve projects) now function also as environmentally competent authorities. This has resulted in 230+ authorities (incl. local governments, environmental authorities, technical supervision, road administration) with variable levels of experience and competence in environmental assessment, compared to two authorities previously performing as environmental assessments authorities across the country. This system of a large number of decision-makers and EIA-competent authorities, with varying levels of management and EIA capacity (sometimes even with conflicting interests) poses the biggest risk of non-compliance with the high standards of the EIA Directive. Examples of such non-compliance have to be attended to by the date of commencement of the revised EIA Directive on 16 May 2017.

Zusammenfassung

Die UVP hat eine lange Tradition in Estland. Die erste Verordnung stammt aus dem Jahr 1992 und das erste Gesetz wurde im Jahr 2000 verabschiedet. Die beiden rechtlichen Instrumente bildeten die Grundlage der Umweltverträglichkeitsprüfung (UVP) und der Strategische Umweltprüfung (SUP). Als Estland der EU 2004 beitrat, wurden Verträglichkeitsprüfungen nach der FHH-Richtlinie eingeführt. Das aktuelle UVP-Gesetz wurde 2005 verabschiedet, wesentliche Änderungen traten am 1.7.2015 in Kraft. Die wichtigste Änderung ist, dass jetzt die für die Entscheidung zuständige Behörde auch für die Umweltbelange zuständig ist. Das größte Risiko für Verstöße gegen die hohen Standards der UVP-Richtlinie besteht jetzt folglich darin, dass mehr als 230 Behörden (einschließlich Gemeinden, Umweltbehörden, technische Fachbehörden, Straßenverwaltung) mit unterschiedlichen Erfahrungen und Kompetenzen in der Umweltprüfung, zuweilen mit Interessenkonflikten, für die Umweltprüfungen zuständig sind. Wo das estnische Recht der UVP-Änderungsrichtlinie nicht entspricht, >muss das >bis zum 16 Mai 2017 behoben werden.
